China : US sets preliminary anti-dumping duty rates on polyester staple

According to Ningbo City Foreign Trade and Economy Bureau, the preliminary duty of anti-dumping investigation on polyester staple fiber, the biggest Sino-US textile trade anti-dumping case, has been set. Ningbo Dafa Chemical Fiber Co., Ltd. is given the anti-dumping rate of 4.39 percent, the minimum among the involved domestic enterprises, which is a better result won through their efforts.

On December 18, the US Department of Commerce published the preliminary finding of the anti-dumping investigation on polyester staple fiber. The anti-dumping duties of the three sample surveyed Chinese enterprises are: 15.35 percent for Cixi Jiangnan Chemical Fiber Co., Ltd., 10.45 percent for Far Eastern Industrial (Shanghai) Co. Ltd., 4.39 percent for Ningbo Dafa Chemical Fiber Co., Ltd. The anti-dumping tax rate for remaining enterprises involved in the case is 9.25 percent, the rate for those enterprises, which are not responded in the case, is 44.30 percent.

It is learned that as a major export base of chemical fiber products, the involved amount from Ningbo City Cixi Chemical fiber industry reached US $25 million, accounting for about 40 percent of the total amount of the involved export products at the same period. Of which, Ningbo Dafa Chemical Fiber Co., Ltd. exported $14 million of polyester staple fiber to the US in the time of investigation, becoming the most affected Chinese enterprise.

Therefore, Ningbo Dafa Chemical Fiber Co., Ltd. came into urgentaction. They recruited a lawyer’s team from China and the US to work together, actively defending their interests, seeking separate rate. Now they have all the questionnaires submitted to the US, and have completed preparation of declaring materials to the US. They are ready for the inspection by the US investigation team.

Due to their efforts in the fight, they ultimately forced the US Department of Commerce to make a concession. The final finding result of the case will be announced next February.
